Village of New London Recreation Park Horse Arena
Section 1. Horse Arena Description
The Horse Arena is a public facility located at 2 Blake Street, New London, Ohio 44851, owned and operated by the Village. Its primary purpose is to serve community equestrian activities, horse shows, training, clinics, exhibitions, and similar events.
Section 2. Rental Terms and Conditions
a. Rental Term. The rental period for use of the Horse Arena shall commence on (time specified below) and shall continue through (time specified below), unless terminated earlier in accordance with the provisions herein. Renter may request additional dates and times, which shall be subject to written approval by the Village. Renter shall ensure that the specified period of occupancy is strictly observed and that all activities occur within the agreed timeframe. b. Rental Fee. Renter agrees to pay the Village $__400__as the rental fee. Payment is due in full prior to the event unless otherwise agreed to by the parties in writing. c. Cancellation Policy. Cancellations must be made in writing at least __60__days prior to the event for a full refund. Late cancellations may result in the forfeiture of the deposit. d. Use Restrictions. The Horse Arena may only be used for approved equestrian and related activities of the scheduled event. No other types of events are permitted without express written consent from the Village.
SECTION 3. OBLIGATIONS OF THE RENTER
Renter acknowledges and agrees to the following obligations: a. Obtain any required permits, licenses, or insurance necessary for the event, prior to the use of the Horse Arena. b. Ensure all attendees comply with Village rules, ordinances, and posted Horse Arena regulations. c. Supervise all participants and spectators at all times, providing adequate staffing for safety and event management. 2 d. Remove all decorations, equipment, manure, hay, trash, and personal property at the conclusion of the event. e. Return the Horse Arena and all facilities (stalls, restrooms, parking areas, warm-up rings) to their original, clean condition. f. Promptly report any damage or hazardous conditions to the Village.
SECTION 4. OBLIGATIONS OF THE VILLAGE
The Village acknowledges and agrees to the following obligations: a. Provide access to the Horse Arena and supporting facilities as scheduled and agreed. b. Maintain the Horse Arena surface and infrastructure in safe, usable condition. c. Make available any Village-owned equipment specified in the Agreement (e.g., barrels, poles, jumps), subject to prior arrangement. d. Return the Renter’s security deposit, less any charges for damages or additional cleaning.
SECTION 5. INSURANCE AND LIABILITY
The Renter is required to provide a Certificate of Insurance with general liability coverage of at least $1,000,000 per occurrence, naming the Village of New London as an additional insured. The Renter assumes all responsibility and liability for participants, horses, equipment, and spectators during the rental period. The Village is not liable for any injury, loss, or damage to persons, animals, or property arising out of or in connection with the Renter’s use of the Horse Arena, except as may be caused by the Village’s gross negligence or willful misconduct. The Renter shall indemnify and hold harmless the Village, its employees, officers, and agents from any claims, damages, or lawsuits resulting from the event.
SECTION 6. INDEMNIFICATION
The Renter agrees to indemnify, defend, and hold the Village of New London harmless against any, and all claims, liabilities, losses, damages, or expenses (including reasonable attorney fees) arising from Renter's use of the Horse Arena.
SECTION 7. ASSIGNMENT AND SUBLETTING
The Renter shall not assign this Agreement or sublet the Horse Arena to any other group or individual without the prior written consent of the Village.
SECTION 8. RIGHT OF ENTRY
Village representatives reserve the right to enter the Horse Arena and all related facilities at any time during the rental period to inspect, monitor, or address safety concerns.
SECTION 9. TERMINATION
The Village reserves the right to terminate this Agreement immediately if the Renter fails to comply with any conditions herein or if the Village determines that safety or property is at risk.
SECTION 10. FORCE MAJEURE
In the event of weather emergencies, natural disasters, or other circumstances beyond the control of either party, the Village may cancel or reschedule the event without penalty.
SECTION 11. AMENDMENTS
No amendment or modification to this Agreement is valid unless in writing and signed by both parties.
SECTION 12. ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties with respect to the subject matter and supersedes any prior oral or written agreements.
This Agreement is executed by the duly authorized representatives of the parties as of the Effective Date. By acknowledging below, each party acknowledges and agrees to abide by all terms and conditions contained herein.
